In this article, we propose a novel account of general jurisprudence by situating it within the broader project of metanormative inquiry. We begin by showing how general jurisprudence is parallel to another well-known part of that project, namely, metaethics. We then argue that these projects all center on the same task: explaining how a certain part of thought, talk, and reality fits into reality overall. Metalegal inquiry aims to explain how legal thought, talk, and reality fit into reality. Although informed consent is important in clinical research, questions persist regarding when it is necessary, what it requires, and how it should be obtained. The standard view in research ethics is that the function of informed consent is to respect individual autonomy. However, consent processes are multidimensional and serve other ethical functions as well. These functions deserve particular attention when barriers to consent exist. We argue that consent serves seven ethically important and conceptually distinct functions. The first four functions pertain (...) principally to individual participants: (1) providing transparency; (2) allowing control and authorization; (3) promoting concordance with participants' values; and (4) protecting and promoting welfare interests. Three other functions are systemic or policy focused: (5) promoting trust; (6) satisfying regulatory requirements; and (7) promoting integrity in research. Reframing consent around these functions can guide approaches to consent that are context sensitive and that maximize achievable goals. (shrink)

Stakeholder theory is widely recognized as a management theory, yet very little research has considered its implications for individual managerial decision-making. In the two studies reported here, we used stakeholder theory to examine managerial decisions about balancing stakeholder interests. Results of Study 1 suggest that indivisible resources and unequal levels of stakeholder saliency constrain managers’ efforts to balance stakeholder interests. Resource divisibility also influenced whether managers used a within-decision or an across-decision approach to balance stakeholder interests. Authorising euthanasia and assisted suicide with advance euthanasia directives is permitted, yet debated, in the Netherlands. We focus on a recent controversial case in which a Dutch woman with Alzheimer’s disease was euthanised based on her AED. A Dutch euthanasia review committee found that the physician performing the euthanasia failed to follow due care requirements for euthanasia and assisted suicide. This case is notable because it is the first case to trigger a criminal investigation since the 2002 Dutch euthanasia law (...) was enacted. Thus far, only brief descriptions of the case have been reported in English language journals and media. We provide a detailed description of the case, review the main challenges of preparing and applying AEDs for persons with dementia and briefly assess the adequacy of the current oversight system governing AEDs. While there is a growing literature on “dark traits” (i.e., socially aversive traits), there has been a lack of integration with the burgeoning research literature on positive traits and fulfilling and growth-oriented outcomes in life. To help move the field toward greater integration, we contrasted the nomological network of the Dark Triad (a well-studied cluster of socially aversive traits) with the nomological network of the Light Triad, measured by the 12-item Light Triad Scale (LTS). The LTS is a first draft (...) measure of a loving and beneficent orientation toward others (“everyday saints”) that consists of three facets: Kantianism (treating people as ends unto themselves), Humanism (valuing the dignity and worth of each individual), and Faith in Humanity (believing in the fundamental goodness of humans). Across four demographically diverse samples (N = 1,518), the LTS demonstrated excellent reliability and validity, predicting life satisfaction and a wide range of growth-oriented and self-transcendent outcomes above and beyond existing measures of personality. In contrast, the Dark Triad was negatively associated with life satisfaction and growth-oriented outcomes, and showed stronger linkages to selfish, exploitative, aggressive, and socially aversive outcomes. This exploratory study of the contrasting nomological networks of the Light vs. Dark Triad provides several ways forward for more principled and data driven approaches to explore both the malevolent and benefice... Research suggests that the mind contains a set of adaptations for detecting alliances: an alliance detection system, which monitors for, encodes, and stores alliance information and then modifies the activation of stored alliance categories according to how likely they will predict behavior within a particular social interaction. Previous studies have established the activation of this system when exposed to explicit competition or cooperation between individuals. In the current studies we examine if shared political opinions produce these same effects. In particular, (...) if participants will spontaneously categorize individuals according to the parties they support, even when explicit cooperation and antagonism are absent, and if party support is sufficiently powerful to decrease participants’ categorization by an orthogonal but typically-diagnostic alliance cue . Evidence was found for both: Participants spontaneously and implicitly kept track of who supported which party, and when party cross-cut race—such that the race of targets was not predictive of party support—categorization by race was dramatically reduced. To verify that these results reflected the operation of a cognitive system for modifying the activation of alliance categories, and not just socially-relevant categories in general, an identical set of studies was also conducted with in which party was either crossed with sex or age . As predicted, categorization by party occurred to the same degree, and there was no reduction in either categorization by sex or by age. All effects were replicated across two sets of between-subjects conditions. These studies provide the first direct empirical evidence that party politics engages the mind’s systems for detecting alliances and establish two important social categorization phenomena: that categorization by age is, like sex, not affected by alliance information and that political contexts can reduce the degree to which individuals are represented in terms of their race. ‘‘Undone science’’ refers to areas of research that are left unfunded, incomplete, or generally ignored but that social movements or civil society organizations often identify as worthy of more research. This study mobilizes four recent studies to further elaborate the concept of undone science as it relates to the political construction of research agendas. Using these cases, we develop the argument that undone science is part of a broader politics of knowledge, wherein multiple and competing groups struggle over the construction (...) and implementation of alternative research agendas. Overall, the study demonstrates the analytic potential of the concept of undone science to deepen understanding of the systematic nonproduction of knowledge in the institutional matrix of state, industry, and social movements that is characteristic of recent calls for a ‘‘new political sociology of science.’’. Indeed, for many the idea that the physical world can act upon the (...) mind at all is a complete mystery on Descartes' principles, not least because the difference between the spatial and divisible nature of body and the non-spatial and indivisible nature of mind seems to preclude the possibility of body-mind contact or of a mechanism for such contact.1 Despite this, however, Descartes repeatedly affirms that body and mind interact causally. He claims that the fact of their disparate natures poses no special difficulty, and he even affirms that the mind and body can form a union (in the case of the human being).2In this paper I wish to examine two issues pertaining to the body-mind relation in Descartes' philosophy. First, I ask whether Descartes advances body-mind occasionalism: is there evidence in his writings of the view that bodies are not genuine causes of sensations, but are mere 'occasions' for God's production of sensations? Recently, it has been urged that Descartes begins his career as a body-mind causal interactionist, but perhaps ends as an occasionalist.3 [End Page 503] In Section 1 of what follows I argue against this. I attempt to show both that Descartes never strays from the body-mind interactionism which he is generally thought to espouse, and that he would undermine his proof of the material world if he did. The second issue I deal with concerns a position closely related to occasionalism which Steven Nadler has recently identified as body-mind "occasional causation."4 In Section 2 of the following I provide an interpretation of occasional causation as it appears in Descartes' reply to Regius in the Comments on a Certain Broadsheet. I argue that Descartes' occasional causation amounts to a form of interactionism which I term "inefficacious body-mind transmissionism." 1. Does Descartes Espouse Body-Mind Occasionalism? 1.1. Daniel Garber's Case for Descartes' Move Toward Body-Mind Occasionalism Occasionalism, roughly defined, is a doctrine according to which God's will is the only genuine efficient or productive cause that exists, and all other so-called 'causes' are really just 'occasions' for the exercise of that will.5 As Daniel Garber understands the term in "Descartes and Occasionalism," an occasional cause is "a cause whose effect is produced through the activity of God," and not through the exercise of any causal power within finite things.6 Body-mind occasionalism is a logical inevitability in Descartes' philosophy, Garber claims, because for Descartes "God is responsible for all motion in the inanimate world."7 The idea is that because there is no causal action on the part of bodies, bodies cannot act causally on anything, let alone minds.8Because for Garber body-body occasionalism is "as clear as anything" in Descartes' philosophy, he sets out to find evidence in Descartes' writings for [End Page 504] the body-mind occasionalism which it implies. It is Garber's case for body-mind occasionalism that I contest below, where I argue that Descartes remains a body-mind interactionist throughout his life. Clearly, my assessment of Descartes puts me at odds with Garber's more general view that Descartes is a body-body occasionalist, at least on the assumption that Descartes has a logically consistent position on body-body and body-mind causation. For, to reiterate Garber's point, to be logically consistent overall Descartes cannot be both a body-body occasionalist and a body-mind interactionist. This paper replies to Fred Ablondi’s discussion of Descartes’s treatment of madness in the Meditations. Against Ablondi’s interpretation that Descartes never seriously takes on board the skeptical hypothesis that he might be mad, because to do so would be for him to undermine the logical thought processes required to realize his agenda in the Meditations, I contend that Descartes does employ madness as a skeptical device, by assimilating its skeptical essentials into the dream argument. I maintain that while Descartes does (...) not use madness to undermine logical processes, he does adduce other considerations that reveal him to be prepared to see those processes undermined. On the question why Descartes abandons madness in the Meditations, I argue that, despite its attractiveness as a skeptical device, the madness hypothesis involves methodological shortcomings that render it unfit for service in the doubt. The main question that Firestone & Scholl (F&S) pose is whether “what and how we see is functionally independent from what and how we think, know, desire, act, and so forth” (sect. 2, para. 1). We synthesize a collection of concerns from an interdisciplinary set of coauthors regarding F&S's assumptions and appeals to intuition, resulting in their treatment of visual perception as context-free.

Much education research takes place under a convenient but spurious assumption that there is a common purpose to education research, and a common epistemology. This book takes a clear-sighted and perceptive look at the underlying truths of education research, and in refining our understanding of the subject paves the way to improving our methods and practice. It addresses the theoretical conceptual elements educational discourses that inform most debates about educational research, including: education and its relationship to research; the problems and (...) possibilities of quantification; and the diversity of methods researchers can use to create theory. Educational research theorists have accepted that different methods are appropriate in different circumstances: that a multi-method approach is therefore the best option. This has given a spurious legitimacy to the idea that members of the education research community share a common purpose, a common way of looking at educational matters and a common epistemology. They offer six different perspectives on the relationship that is central to the creation of (...) knowledge about educational systems, institutions and actors: between the knower and what they come to know. Research indicates that the well‐being and productivity of over 100 million people in the global workforce may be compromised by posttraumatic stress (PTS). Given that work‐related experiences are often the source of the trauma that leads to PTS, and that PTS due to any cause can interfere with employees’ job performance, organizations would do well to consider the antecedents and consequences of PTS. This review of research—primarily within fields adjacent to business—on the types, antecedents, consequences, and organizational implications of PTS (...) is presented to advance inquiry within the field of business. The definition of PTS requires attention to the new classification of complex posttraumatic stress disorder that can result from threats that are not life‐threatening such as bullying and sexual harassment. PTS antecedents include organizational and extraorganizational traumas, and risk and resilience factors. Absenteeism, impaired cognitive functioning, strained relationships, and growth are among the consequences of PTS. Organizations can assist through disaster planning, empathetic leaders, mental health literacy initiatives, and employee assistance programs. Many research questions arise that, when answered, will allow organizations to better understand how they can improve employee productivity and well‐being by attending to PTS. (shrink)

Understood one way, the branch of contemporary philosophical ethics that goes by the label “metaethics” concerns certain second-order questions about ethics—questions not in ethics, but rather ones about our thought and talk about ethics, and how the ethical facts (insofar as there are any) fit into reality. Analogously, the branch of contemporary philosophy of law that is often called “general jurisprudence” deals with certain second-order questions about law—questions not in the law, but rather ones about our thought and talk about (...) the law, and how legal facts (insofar as there are any) fit into reality. Put more roughly (and using an alternative spatial metaphor), metaethics concerns a range of foundational questions about ethics, whereas general jurisprudence concerns analogous questions about law. As these characterizations suggest, the two sub-disciplines have much in common, and could be thought to run parallel to each other. Yet, the connections between the two are currently mostly ignored by philosophers, or at least under-scrutinized. The new essays collected in this volume are aimed at changing this state of affairs. The volume collects together works by metaethicists and legal philosophers that address a number of issues that are of common interest, with the goal of accomplishing a new rapprochement between the two sub-disciplines. We are grateful to Jongsma et al 1 for their interest in our article analysing the case of ‘Mrs A’, a Dutch woman with Alzheimer’s disease who received euthanasia based on her advance euthanasia directive.2 Their commentary criticises two elements of our analysis. First, the authors believe our reasons for doubting that Mrs A had the capacity to write and revise an AED rely on ‘partial’ empirical data and rest on normative errors. Second, they use two of our statements to (...) suggest we must endorse some implausible claims, for example, that ‘… in all situations and for all people, current well-being should always take precedence over all other values’. Jongsma et al assert: ‘Miller et al argue that people with dementia are impaired to make decisions.’ This casts our probabilistic claim about Mrs A’s capacity as an absolute claim about persons with dementia in general. It also implies we are using an outdated diagnosis-based view of capacity. The accusation then becomes explicit : > … several empirical studies have shown that patients with dementia are able to actively participate in qualitative studies and can respond to open questions in a meaningful way,[2-8] as well that they are able to complete an advance directive in the early phases of dementia.[9, 10] One can therefore not simply conclude on the basis of the diagnosis of dementia …. In a popular paper, Bruce Russell argues that our nonperception of divine reasons for apparently pointless suffering justifies belief in the nonexistence of God. Russell generally accepts the common interpretive norm that we are justified in believing that something does not exist when we do not perceive it, if and only if we have reason to believe that we would perceive it if it did exist. However, on the strength of an example from the film The Matrix, Russell argues that (...) this interpretive norm does not apply to the belief in God’s nonexistence based on our nonperception of reasons that would justify apparently pointless suffering. My paper undermines Russell’s effort to restrict the scope of this interpretive norm. It thereby leaves open the door to agnosticism. (shrink)

Surveillance in public health is the means by which people who are responsible for preventing or controlling threats to health get the timely, ongoing, and reliable information they need about the occurrence, antecedents, time course, geographic spread, consequences, and nature of these threats among the populations they serve. “Policy surveillance” is the ongoing, systematic collection, analysis, and dissemination of information about laws and other policies of health importance.

Niche construction refers to the activities of organisms that bring about changes in their environments, many of which are evolutionarily and ecologically consequential. Advocates of niche construction theory (NCT) believe that standard evolutionary theory fails to recognize the full importance of niche construction, and consequently propose a novel view of evolution, in which niche construction and its legacy over time (ecological inheritance) are described as evolutionary processes, equivalent in importance to natural selection. Here, we subject NCT to critical evaluation, in (...) the form of a collaboration between one prominent advocate of NCT, and a team of skeptics. We discuss whether niche construction is an evolutionary process, whether NCT obscures or clarifies how natural selection leads to organismal adaptation, and whether niche construction and natural selection are of equivalent explanatory importance. We also consider whether the literature that promotes NCT overstates the significance of niche construction, whether it is internally coherent, and whether it accurately portrays standard evolutionary theory. Our disagreements reflect a wider dispute within evolutionary theory over whether the neo-Darwinian synthesis is in need of reformulation, as well as different usages of some key terms (e.g., evolutionary process). In his Meditations Descartes advances an argument that contains the essentials of the so-called “hard problem” of explaining consciousness. I show how this Cartesian argument was taken up in the twentieth century by C. A. Campbell, the moral libertarian and student of idealist Henry Jones. Campbell can be regarded as the model of what John Passmore and Simon Glendinning have respectively dubbed a “recalcitrant metaphysician” or “honorary Continental” philosopher—labels that attach largely to metaphysically-minded, mainly British thinkers who, with varying degrees (...) of affiliation to idealism, resisted the twentieth-century trends of logical behaviorism and the “revolutionary” linguistic method. In the course of this paper, I situate Campbell’s version of Descartes’ argument within the broader history of the development of the hard problem. (shrink)

Settling the debate over conscientious refusal (CR) in liberal democracies requires us to develop a conception of the healthcare provider’s moral role. Because CR claims and resulting policy changes take place in specific sociopolitical contexts with unique histories and diverse polities, the _method_ we use for deriving the healthcare norms should itself be a democratic, context-dependent inquiry. To this end, I begin by describing some prerequisites—which I call _publicity conditions_—for any democratic account of healthcare norms that conflict or jibe with (...) CR. Next, drawing on Ronald Dworkin’s jurisprudence and Tom Beauchamp & James Childress’s approach to bioethical reasoning, I briefly introduce one method for generating healthcare norms that is faithful to the publicity conditions and has potential to constructively, and democratically, derive important boundaries for CR. Finally, I argue that many critics of CR fail to similarly ground their accounts of healthcare norms in healthcare professionals’ sociopolitical contexts, often relying instead on their own interpretation of a generally stateable healthcare norm. This leads to their misconstruing both the value judgments on which their own approaches rest and the public, political values that are often invoked in favor of CR. (shrink)

African Philosophy and St Thomas Aquinas have both been taught in African universities, but the engagement between the continent’s indigenous philosophical tradition and the Catholic intellectual tradition’s preeminent strand, has not been thorough. Presupposing that plural philosophical traditions contribute to the search to better understand, this research embarks upon a comparative analysis of the perspectives of the African ubuntu philosophy and Thomist philosophical conceptualisations of human becoming and being. Through analysis of dimensions of both traditions, it is contended that human (...) fulness arises through relationality. It is argued that in centring on the interpersonal encounter and the consequent recognition of another’s being through mutual engagement, these philosophical traditions open to each other. Further, both traditions contribute toward the ontology of personhood in ubuntu and the good of mutual indwelling, respectively. (shrink)
